Installation T&Cs

About us and these terms

These terms apply to every bollard supply-and-installation job carried out by Bison Security Posts & Bollards Ltd. Our company number is 09245755 and our registered office is 6 Lords Court, Cricketers Way, Basildon, Essex, United Kingdom, SS13 1SS. Phone: 01708 956833.

"You" means the person or business that accepts our quotation. "Residential customer" means an individual buying for their own home and not for a business. "Commercial customer" means anyone else.

"Works" means the work described in your quotation. This includes scanning, excavation, supply and installation of the bollards, and reinstatement of the surface. "Site" means the property where the Works take place.

Goods bought online without installation are covered by our Website Terms instead. Annual servicing is covered by our Care Plan Terms.

If you are a residential customer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.

Quotations, orders and deposit

Each quotation is based on our survey and on the information you give us about the Site. The "Underground services and scanning" and "Ground conditions and water ingress" sections explain what happens if conditions below ground turn out to be different from what was expected.

A contract is formed when you accept the quotation in writing and we receive a deposit of 50% of the total price. We will not order materials or carry out an installation date until the deposit has cleared.

We use the deposit to buy and reserve the bollards and materials for your job. If you cancel, "Your right to cancel" (residential customers) and "Working hours, scheduling and cancellation" (all customers) explain how much of the deposit we refund.

Your right to cancel (residential customers)

If you are a residential customer and you agreed the contract away from our premises (for example at your home, by phone, by email or online), you may cancel within 14 days of the contract being formed. You do not need to give a reason.

If the Works are due to be carried out within the 14-day period and then you cancel, you may lose any deposit made for any materials ordered specifically for you up to that point. If the Works are fully completed within the 14 days at your request, you lose the right to cancel.

After the 14-day period, the cancellation terms in "Working hours, scheduling and cancellation" apply.

Site access, preparation and permissions

You must give our installers safe and clear access to the Site on the agreed date. Vehicles, skips and stored items must be moved away from the work area beforehand.

You must confirm that you own the Site or have the owner's permission for the Works to go ahead.

You are responsible for any consents the Works need. This includes landlord, freeholder or management-company approval, planning permission, and highways or listed-building consent. We can advise on these but we do not obtain them for you.

You must tell us about any known hazards on the Site before work starts. Examples include soakaways, septic tanks, cellars, retaining walls, underfloor heating, drainage channels and previous excavations.

Underground services and scanning

Our own trained installers scan every excavation point for underground services. They scan before digging starts and again during the excavation, using cable-avoidance equipment. They dig with reasonable care to avoid any services they find.

Scanning equipment cannot detect every service. Plastic pipes, non-metallic ducts, unpowered cables and very deep or poorly installed services may not show up.

You remain responsible for informing us before the Works start, where any pipework, cables or other services run on the Site that are not visible. This includes water and waste pipes, drains, gas pipes, electricity cables (including garden lighting, gates and EV chargers), data cables, irrigation and heating pipes. Plans or drawings should be provided where you have them.

If we damage a service that you did not tell us about and that could not reasonably have been detected using the scanning methods described above, we will not be liable for that damage or for the cost of repairing it. This applies provided that we carried out the scanning and excavation with reasonable care and skill.

If a service is struck, we will stop work, make the area safe and tell you straight away. Where the service belongs to a utility company we will report the damage to them. Any work needed to repair or reroute an undisclosed service will be charged at our standard rates, or carried out by your own contractor.

Ground conditions and water ingress

Water ingress

Telescopic and removable bollards sit in a ground socket below the surface. Where the natural water table is high, groundwater can rise into the socket. This can happen whatever installation method is used.

We take reasonable steps to reduce the risk of water ingress. These include manufacturer installation guidelines which include recommended shingle soak ways. Where we find signs of a high water table during the Works, we will tell you before we finish and explain the options.

Some water ingress cannot be avoided. Water entering a socket because of a high or rising water table, saturated ground, heavy rainfall, flooding or poor natural drainage of the Site is a condition of the Site. It is not a defect in the bollards or in our workmanship.

Water ingress of the kind described above is therefore not covered by our workmanship guarantee. We will not be liable for the cost of pumping out, clearing or servicing sockets affected by it, or for any further drainage work. We can carry out that work for an agreed price. Our Care Plans include regular internal clearing of water, silt and debris.

The two paragraphs above do not apply where water ingress is caused by our failure to install the bollards with reasonable care and skill.

Other ground conditions

If we find conditions during excavation that could not reasonably have been foreseen at survey, we will stop and explain the extra work needed and its cost. Examples are rock, buried concrete eg. historical footings, tree roots, voids. We will only continue once you have agreed the extra cost in writing. If you do not agree, we will make the Site safe and charge only for the work done and materials used.

Working hours, scheduling and cancellation

Our standard working hours are 8am to 5pm, Monday to Friday. Weekend installations are available on request, subject to availability and any weekend rate shown in your quotation. We install across the South East.

Installation dates are agreed with you once the deposit has cleared. Any date we give is our best estimate. We are not liable for delays caused by weather, supplier delays or other events outside our reasonable control, but we will tell you promptly and rebook as soon as we can.

Excavation and surface work cannot always be carried out in heavy rain or freezing conditions. Where weather prevents the work being done properly, we will reschedule at no cost to you.

If our installers arrive on the agreed date and cannot start because the Site is not accessible or not ready as required under "Site access, preparation and permissions", we may charge a wasted-visit fee of £50 to cover our reasonable costs.

Surface reinstatement and finish

Our installers are trained in reinstating driveway and hard-standing surfaces. After installation we will reinstate the surface around each bollard.

We will match the existing surface as closely as reasonably possible in colour, material and pattern. An exact match cannot be guaranteed. Existing surfaces weather and fade over time, and replacement materials (block paving, tarmac, resin, concrete or slabs) may come from different batches or may no longer be made. A visible difference in colour or texture between new and existing surface is not a defect.

New surfaces need time to cure. We will tell you how long to keep vehicles off the reinstated area. We are not liable for damage caused by driving or parking on it before that time has passed.

Excavated spoil will be removed from site unless your quotation says otherwise.

Payment

The below does not apply to installation add-ons bought through the website.

We will invoice the remaining 50% balance when the Works are completed. It is due for payment on the day the invoice is issued.

Payment can be made by BANK TRANSFER / CARD . Our bank details will be on the invoice only. We will never change them by email. If you receive a message saying our bank details have changed, phone us on 01708 956833 before making any payment.

If extra work has been agreed under "Underground services and scanning" or "Ground conditions and water ingress", it will be added to the final invoice.

If you are unhappy with any part of the Works, please tell us promptly so we can put it right. You should still pay any part of the invoice that is not in dispute.

Ownership of the bollards and our right to remove them

The bollards and all materials we supply remain the property of Bison Security Posts & Bollards Ltd until the full balance has been paid. "Full balance" includes any agreed extra work, interest and recovery costs. This applies even after the bollards have been installed.

From the time the bollards are delivered to the Site, you are responsible for their safe-keeping and for any loss or damage to them.

If any amount owed to us is more than 30 days overdue, we have the right to remove the bollards from the Site.

By accepting these terms, you give us and our installers permission to enter the Site during our working hours to remove the bollards. You confirm that you have the authority to give that permission. This permission continues until the full balance is paid.

Workmanship guarantee

We guarantee our installation workmanship for 24 months from the date the Works are completed. If a fault caused by our workmanship appears in that period, we will put it right free of charge. Examples are a bollard or socket that becomes loose, misaligned or sunken, or reinstated surface that fails.

The bollards themselves are covered by the manufacturer's warranty.

This guarantee does not cover:

  • water ingress caused by Site conditions (see "Ground conditions and water ingress")

  • differences in colour or texture between the reinstated and existing surface (see "Surface reinstatement and finish")

  • vehicle impact, misuse, vandalism, or damage caused by not following our operating instructions

  • normal wear and tear, or lack of routine maintenance, such as clearing silt and debris from sockets

  • ground movement, subsidence or tree-root activity

  • work carried out on the bollards by anyone other than Bison

The guarantee only applies once the full balance has been paid.

To make a claim, contact us on 01708 956833 with photographs of the problem. We will arrange an inspection within 7 working days.

If you are a residential customer, this guarantee is in addition to your statutory rights. It does not replace them.

Liability

Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by our negligence

  • fraud or fraudulent misrepresentation

  • anything else that cannot legally be limited or excluded, including a residential customer's rights under the Consumer Rights Act 2015

Our bollards are designed to deter and restrict vehicle access. They do not guarantee against theft, break-in or determined attack. Unless your quotation names a specific crash-rated product, they are not rated to stop a vehicle impact.

Residential customers: if we fail to keep to these terms, we are responsible for loss or damage you suffer that was a foreseeable result of our failure. We are not responsible for loss that was not foreseeable.

Commercial customers: we are not liable for loss of profit, business, revenue or goodwill, or for any indirect or consequential loss. Our total liability in connection with each contract is limited to the price of the Works under that contract, except for the liabilities listed at the start of this section.
