Frequently Asked Questions

What are the rules for smoking shelters in the UK?

A smoking shelter must be at least 50% open to the air. Anything more enclosed than this is considered substantially enclosed under the Health Act 2006 and the Smoke-free (Premises and Enforcement) Regulations 2006, which would then make it smoke-free.

The calculation considers only the walls, not the roof or floor. Doors and windows count toward the enclosed portion even when open, so a shelter with a roof, a back panel, and two open sides comfortably meets the requirement.

There is no minimum distance from a building specified in the legislation. The practical consideration is that smoke should not drift back inside, so most sites position a shelter several metres from any entrance, window, or ventilation intake.

What should be considered before installing smoking shelters?

A shelter is a permanent structure, so some groundwork is worth doing in advance:

  • Base: Most shelters bolt down onto a level, solid surface such as concrete or tarmac, which may need to be laid first.
  • Position: Place the shelter away from entrances, open windows, and air intakes to prevent smoke from being drawn indoors.
  • Fire Safety: Locate the shelter away from fuel, chemical, or LPG storage, and provide a suitable ashtray or cigarette bin. Ashtrays are available as add-ons with most shelters in our range.
  • Planning Permission: Most shelters fall under permitted development, but approval may be required in conservation areas or near listed buildings.
  • Signage: Displaying no-smoking signs inside the building is also a legal requirement (although that is separate from the shelter itself).

Our cycle shelters and bin shelters face some of the same considerations.
